An IV hydration business is not automatically AHCA licensed, and not automatically exempt because it is cash-pay. The entity should be analyzed under Florida’s Health Care Clinic Act to determine whether it meets the statutory definition of a “clinic” and, if so, whether a specific exclusion or exemption applies. §400.9905 defines “clinic,” “medical director,” and “mobile clinic” and lists the exclusions/exemptions.

Why does AHCA status matter for an IV hydration clinic?
If the entity is an AHCA-licensed Health Care Clinic, the medical/clinic director has statutory responsibilities under §400.9935. If it qualifies for an exemption, the practice should document the actual statutory basis rather than simply labeling itself “AHCA exempt.”
Does the Health Care Clinic analysis apply to mobile IV operators?
§400.9905 addresses “mobile clinic” concepts, so mobile IV operators in particular should not assume the Health Care Clinic analysis is irrelevant to them — analyze the model as it actually operates.
Owner takeaway
“We don’t bill insurance” is not a complete AHCA analysis. Identify the specific statutory basis for the clinic’s status and document it. Confirm with AHCA guidance and counsel.
